Terms of Use for the Mons App

1. General

1.1 Mons is an app that helps you identify the mountains and peaks around you – as a drawn panorama and in the camera image.

Mons is provided by OSTREUM GmbH, Leopoldstr. 53, 80802 Munich, Germany ("we", "us" or "our").

For general questions, you can reach us at this address or by email at support@mons-app.com.

1.2 These Terms of Use govern your use of Mons. They apply in addition to the terms of the app store from which you obtained Mons (Apple App Store or Google Play). The purchase itself is handled through the respective app store (see Section 2).

1.3 The user agreement with us is concluded when you install Mons after purchasing it and accept these Terms of Use when you first start the app.

1.4 If you are not yet legally able to enter into contracts on your own, you need the consent of your parents or legal guardians.

2. Purchase, Price and Payment

2.1 Mons is a paid app. You obtain it for a one-time payment in the Apple App Store or on Google Play. There is no subscription and there are no recurring costs.

2.2 The purchase is handled entirely through the respective app store. In the European Union and in many other countries, the app store sells Mons in its own name and is your contractual partner for the purchase; in other countries, it acts as our agent. In every case, the app store processes the payment, issues the invoice and is responsible for refunds, and its terms of sale apply, including to your statutory right of withdrawal. You therefore exercise any right of withdrawal through the app store (for Apple via "Report a Problem" or your purchase history, for Google Play via your order history). Prices, including any applicable sales tax or VAT, are shown in the app store before you buy.

2.3 The purchase price includes the features of the app as well as downloading terrain and peak data to the extent offered in the app at the time.

2.4 In the future, we may offer additional content or features for a separate charge, such as further data packages. You would also purchase such offers through the app store, and we will show you the price before you buy.

2.5 Whether you can share Mons with others through the app store's family sharing depends on the settings and terms of the respective app store.

3. What Mons Offers

3.1 Mons shows you a panorama drawn from terrain data, with peak names, elevations and distances – for your current location or for a virtual viewpoint of your choice. In camera view, Mons overlays the peak names on the live camera image.

3.2 Mons also offers, in particular, a peak search, a list of visible mountains, favorites and saved viewpoints, sun and moon paths, your own labeled photos that you can edit, export and share, and offline areas.

3.3 To use Mons without an internet connection, you download terrain and peak data for the areas you want to your device. An internet connection is required for downloads, data updates, online search and the profile backup.

3.4 By default, Mons backs up your favorites, saved viewpoints and transferable settings on our servers so that you can restore them on a new device of the same platform (iOS or Android). You do not need a user account for this. Restoring requires that your operating system's backup and transfer features are available and set up. Mons does not support switching between iOS and Android. Mons does not back up photos on our servers; they remain on your device. You can turn off the profile backup in the settings at any time. For details, please see the Privacy Policy.

4. Data Accuracy and Safety in the Mountains

4.1 Mons calculates the panorama and labels from terrain models, peak data and your device's sensors (location, compass, orientation and motion sensors, camera). Peak names, positions and elevations come mainly from public data sources such as OpenStreetMap and GeoNames, which are maintained in part by volunteers. The sources we use are listed in the app under "Legal" → "Data Sources and Licenses".

4.2 We select and check the data with reasonable care. Nevertheless, names, elevations and positions may be missing, outdated or inaccurate. The accuracy of the display also depends on the quality of the terrain data in the respective region and on the measurement accuracy of your device. Smartphone compasses and location services can deviate considerably, for example due to metal, magnetic fields or poor satellite reception. Labels may therefore be offset; in that case, you can correct the alignment in the app.

4.3 Mons is a tool for identifying and naming mountains. Mons is not a navigation device and not a map for planning tours. Do not rely on Mons for route finding, orientation in the terrain, emergencies or other safety-related decisions; use suitable maps, equipment and information instead. Pay attention to your surroundings and your safety when using the camera.

4.4 Your statutory rights in the event of defects remain unaffected (see Section 6).

5. Availability, Updates and Devices

5.1 The core features of Mons are available offline once the required area data has been fully downloaded to your device.

5.2 Our online services (area downloads, data updates, online search and profile backup) may be temporarily limited due to maintenance, technical faults or events beyond our control.

5.3 Terrain and peak data require storage space on your device. Mons shows you the size before each download. To protect your storage and our systems, the number or total size of areas stored at the same time may be limited; you can remove downloaded areas at any time and download them again later. By default, downloads use Wi-Fi; Mons uses mobile data only if you allow it for the respective download. You bear the costs of your internet connection.

5.4 To protect our area data against abusive bulk retrieval, we check during downloads whether the request comes from an unmodified Mons app on a genuine device, and we limit the number of downloads per device and time period. These limits are set so that they do not affect ordinary use.

5.5 We provide updates to the app, including security updates, through the app store to the extent necessary for Mons to work as agreed. We support the versions of iOS and Android that have a sufficient market share and provide the functions required by Mons. We offer updated terrain and peak data in the app; you decide when to download them. Data that already works is kept until new data has been completely downloaded and verified.

5.6 Mons requires a compatible device with a supported operating system version as well as location, compass, orientation and camera sensors. If your device lacks a sensor, some features, such as the camera view, may not be available.

6. Defects

6.1 Statutory rights in the event of defects apply. For claims arising from the purchase contract, such as a refund of the purchase price, please contact the app store from which you purchased Mons.

6.2 If Mons does not work as described, please let us know via "Help & Feedback" in the app or at support@mons-app.com. We take care of errors in the app and in our data and fix them within a reasonable time.

7. Liability

7.1 We are liable without limitation for damage caused intentionally or by gross negligence, and for damage resulting from injury to life, body or health.

7.2 In the case of slight negligence, we are liable only if we breach a material contractual obligation – that is, an obligation without whose fulfillment you could not use Mons as agreed. In this case, our liability is limited to the damage that is typical and foreseeable for a contract of this kind.

In all other cases, our liability is excluded.

7.3 Mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz) remain unaffected.

8. Permitted Use

8.1 You may use Mons only in accordance with these Terms of Use. In particular, you may not

  • reverse engineer, decompile or modify Mons or any part of it, except as permitted by law,
  • circumvent protective measures that we use to protect the app, our servers or the area data,
  • retrieve area data, peak data or search results automatically or in bulk, use them outside the app or pass them on to third parties, unless the license of the respective data source expressly permits this,
  • use our online services in a way that disrupts their operation or places an excessive load on them,
  • use Mons in any other way that violates these Terms of Use or applicable law.

8.2 If there is a justified suspicion of misuse, we may temporarily or permanently restrict access to the online features concerned. In doing so, we take into account the severity and frequency of the violation as well as your legitimate interests. Provided this does not jeopardize the purpose of the measure, we will inform you of the reason and the expected duration. Data and photos already stored on your device remain unaffected.

9. Right of Use, Intellectual Property and Third-Party Data

9.1 We grant you a simple, non-transferable and non-sublicensable right to use Mons for your private purposes on devices that you own or control. The scope of this right is also governed by the usage rules of the app store from which you obtained Mons.

9.2 The app, its software, design and the content we create are protected by copyright or other intellectual property rights, to the extent such protection exists. Any use beyond the use of Mons as agreed, in particular for commercial purposes, requires our prior consent in text form.

9.3 Mons contains data and software from third parties that are subject to their own licenses, for example peak data from OpenStreetMap (© OpenStreetMap contributors, Open Database License) and terrain models from public sources. The respective license terms also apply to these components; they take precedence over these Terms of Use insofar as they grant you more extensive rights. The sources, licenses and attributions are listed in the app under "Legal".

9.4 Use of our trademarks, logos and business names requires our prior consent in text form.

10. Your Photos and Sharing

10.1 Photos that you take with Mons belong to you. We do not acquire any rights to them; Mons stores them only on your device.

10.2 When you export or share photos, they contain the labels you have chosen and a discreet Mons mark with a link. Location coordinates are not written into the file metadata; however, visible peak names may reveal where a photo was taken.

10.3 You decide whether and with whom you share photos. You are responsible for shared content and for respecting the rights of third parties, in particular the rights of people shown in the photos. The terms of the app or platform to which you pass on a photo apply to its processing there.

11. Term and Termination

11.1 The user agreement runs for an indefinite period. You can terminate it at any time by no longer using Mons and deleting it from your device. Deleting the app removes the data stored on your device, but not an existing profile backup on our servers. You can delete the profile backup in the app settings.

11.2 We may terminate the user agreement for good cause without notice. Good cause exists in particular if we cannot reasonably be expected to continue the agreement because of a serious or repeated violation of these Terms of Use. Where possible, we will inform you in advance and give you the opportunity to stop the violation. Statutory rights remain unaffected.

12. Changes and Discontinuation of Mons

12.1 We continuously develop Mons. Features, content, data sources and design may be added, changed or removed – in particular to develop and improve the app, to adapt to technical developments, changed data sources or user needs, for security reasons, due to legal requirements or for economic reasons. Such changes will not cause you any additional costs. We will inform you in good time beforehand about changes that impair your use of Mons more than insignificantly. Your statutory rights remain unaffected.

12.2 We may discontinue our online services in whole or in part. We will inform you in the app of a planned discontinuation at least 30 days in advance, unless legal, technical or security-related reasons require a discontinuation at short notice. You can continue to use area data already downloaded to your device offline for as long as the app runs on your device. You will still be able to have your profile backup deleted. Your statutory rights remain unaffected.

12.3 We may change these Terms of Use if there is an objective reason – for example, because laws change, we develop Mons further or it becomes technically necessary. We will inform you in the app about important changes. Where your consent is required, the amended Terms of Use apply only once you have accepted them.

13. Additional Terms for Purchases from the Apple App Store

If you obtained Mons from the Apple App Store, the following also applies:

13.1 This user agreement is concluded between you and us only, and not with Apple Inc. or its subsidiaries ("Apple"). We, not Apple, are solely responsible for Mons and its content.

13.2 The right of use under Section 9.1 applies to Apple-branded products that you own or control, as permitted by the Usage Rules set forth in Apple's Media Services Terms and Conditions. Mons may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

13.3 We are solely responsible for providing maintenance and support for Mons. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Mons.

13.4 In the event of any failure of Mons to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Mons. As between us and Apple, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are our sole responsibility, to the extent such responsibility cannot be excluded. Your statutory rights under Section 6 remain unaffected.

13.5 We, not Apple, are responsible for addressing any claims by you or any third party relating to Mons or your possession and use of Mons, including but not limited to product liability claims, claims that Mons fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

13.6 In the event of any third-party claim that Mons or your possession and use of Mons infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of any such claim.

13.7 You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

13.8 Please direct any questions, complaints or claims regarding Mons to the address given in Section 1.1.

13.9 Apple and its subsidiaries are third-party beneficiaries of this user agreement. Upon your acceptance of these Terms of Use, Apple will have the right to enforce this agreement against you as a third-party beneficiary.

14. Final Provisions

14.1 These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another country, the mandatory consumer protection provisions of that country remain unaffected.

14.2 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14.3 If individual provisions of these Terms of Use are invalid, the remaining provisions remain unaffected. The invalid provision is replaced by the statutory provisions.

14.4 We provide these Terms of Use in several languages. In the event of any discrepancy between the language versions, the English version prevails, unless mandatory law of your country of residence provides otherwise.
